Terms of Service

These Terms of Service ("Terms") form a legally binding agreement between you ("you" or "User") and Cambridge Vision Technology Ltd. ("Aykua," "we," or "us") concerning your use of the Aykua patient portal and related payment pages (collectively, the "Service"). By submitting a form request, making a payment, or otherwise using the Service, you agree to these Terms.

1. What the Service Does
Aykua is an online service that helps facilitate the completion of administrative medical paperwork (for example, an FMLA form) between U.S. patients and their healthcare provider ("Provider"). In order to offer the Service, we:
- Collect the information you enter on our website.
- Share that information with your Provider to help them complete a specific paperwork request.
Aykua does not provide medical or legal advice and is not a healthcare provider. The final decision to approve, deny, or otherwise complete your form rests solely with your Provider.
2. Who Can Use the Service
- You must be 18 years or older and resident in the United States.
- By submitting a request, you confirm that the information you provide is accurate and that you have the right to request the form (if applicable).
- You agree not to use the Service for emergencies. If you have a medical emergency, call 911 or your local emergency number.
3. Payments & Fees
- Variable fee. The cost depends on the form type and is shown before checkout.
- Up-front payment. Your card is charged immediately via Stripe. We never store full card details.
- No-outcome guarantee. Our fee covers all aspects of processing your request, including your healthcare provider's time. We cannot guarantee certain outcomes, such as whether a provider will approve or deny a request for leave under the FMLA.
- Refunds. If your form cannot be processed and we cannot resolve the issue within a reasonable time, we will refund the fee to the original payment method.
4. Turnaround Time
We aim to process requests as quickly as possible, but we don't promise a specific timeframe. Completion depends on your provider's availability and willingness to act.
5. User Responsibilities
You agree to:
- Provide accurate, complete, and lawful information.
- Pay the posted fee.
- Use the Service only for lawful purposes.
6. Medical & Legal Disclaimer
THE SERVICE IS PROVIDED FOR ADMINISTRATIVE CONVENIENCE ONLY – Aykua is not a healthcare provider and does not give medical, legal, or employment advice. Always consult a qualified professional for healthcare or legal questions. Do not use the Service for urgent or emergency matters.
7. Intellectual Property
All content on the Service is owned by Aykua or its licensors. You may use it only for personal, non-commercial purposes related to your paperwork request.
8. Limitation of Liability
To the fullest extent permitted by law, Aykua's total liability for any claim arising out of or relating to these Terms or the Service shall not exceed the fee you paid for the specific form request. We are not liable for indirect, incidental, or consequential damages, loss of income, or loss of opportunity.
9. Service Availability & Maintenance
We aim to keep the Service running smoothly, but access may occasionally be suspended, limited, or modified – for example, for maintenance, security updates, or to comply with the law. Where practical, we'll let you know in advance; otherwise, we'll do so as soon as reasonably possible.
10. Force Majeure
We are not liable for any delay or failure to perform caused by circumstances beyond our reasonable control, including but not limited to natural disasters, power or Internet outages, labour disputes, government actions, or acts of terrorism. We will resume performance as soon as those circumstances end.
11. Severability
If any part of these Terms is found unenforceable, that part will be limited or removed to the minimum extent necessary, and the rest of the Terms will remain in full force and effect.
12. Assignment
You may not assign or transfer any rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations (for example, in connection with a merger, acquisition, or sale of assets) provided the new owner honours these Terms.
13. Entire Agreement
These Terms and our Privacy Policy are the entire agreement between you and Aykua regarding the Service and supersede any prior statements or agreements.
14. Governing Law
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules.
15. Dispute Resolution
If you have a concern, email support@aykua.com and we'll try to resolve it within 30 days. If we can't agree, either of us may choose to resolve the issue through binding arbitration in Delaware, using a neutral third party. Disputes must be brought individually and not as part of a class action.
16. Changes to These Terms
We may update these Terms from time to time. We'll post the revised version with a new "Last updated" date. Continued use of the Service after changes become effective means you accept the new Terms.
